Burlington Stores, Inc., and its affiliates and subsidiaries, including Burlington Coat Factory and Burlington Coat Factory Warehouse, (“Burlington”), respects your privacy and values your trust. This is why we are committed to protecting your privacy and using the information you share with us responsibly to better serve you. This Privacy Policy describes how Burlington and some of its third-party service providers collect, use, disclose and safeguard the personal information you provide on our website, www.burlington.com (the “Site”), as well as information collected when you visit our stores, through interest-based online advertising, or otherwise communicate or interact with us.

As used in this Privacy Policy, “Personal Information” means information that identifies or can reasonably be linked to a specific individual, such as name, address, e-mail address, phone number, driver’s license number, or credit card number.

Our Site is intended for users located exclusively in the United States of America. The information practices and the terms of this Privacy Policy may or may not comply with foreign law. By using our Site, you consent to the use and disclosure of your information in accordance with this Privacy Policy and subject to the applicable state and federal laws of the United States.
INFORMATION COLLECTED
Burlington and its third party service providers collect Information about you from a variety of sources, including Personal Information you provide directly to us, and information we collect about you when you access and use our Site or shop in our stores. We may combine any of the Information collected about you for the purposes described in this Privacy Policy.
- Identifying information: We may collect your personal Information such as your name, online identifier, unique personal identifier (such as a device identifier; cookies, beacons, pixel tags, mobile ad identifiers and similar technology; customer number, unique pseudonym, or user alias; telephone number and other forms of persistent or probabilistic identifiers), mailing addresses, email address(es), phone numbers, internet protocol address, email address, account name, , and other similar identifiers;
- Social Media: When you interact with, or if you are a fan/follower of, Burlington on social media, we may receive information such as your user ID, handle, your profile picture, photos you post, and other profile elements, including any comments, with us. Note that your use of social media is subject to the terms and conditions and privacy policies of each respective social media platform, and the information you share with us and with others is largely controlled by the privacy settings you have established at those platforms.
- Information you submit: we may collect preference information, survey answers/opinions, or customer service information, which you submit to us in connection with various marketing and promotional activities, surveys or contests.
- Demographic Information: we may collect your education level, income level, birthdate, gender, marital status, number of children and their ages, and zip code.
- Payment information: we may collect your signature, bank account number, credit card number, debit card number, billing address and other financial information.
- Commercial Information: we may collect information about the products you purchased or considered purchasing from us, as well as your other purchasing or consuming histories or tendencies.
- Sensitive personal information: We may collect, for example, social security number, driver’s license number or other state identification card number, login credentials, racial/ethnic origin information, and precise geographic location information from your device by, for example using its GPS information, IP Address, cell phone tower information, or WiFi signals.

- Device and Browsing Information: We collect certain information about your computer or device each time you access our Site. Servers may automatically record certain log file information such as your web request, Internet Protocol (IP) address, MAC address, internet provider, physical location data, operating system and browser type, device type, referring / exit pages and URLs, number of clicks and how you interact with Linked Sites, domain names, landing pages, pages viewed, browsing history, and other such information.
- Clear Gifs/Web Beacons: When you use our Site, we may employ clear gifs (also known as web beacons) which are used to track your online usage patterns. In addition, we may also use clear gifs in HTML-based emails sent to our users to track which emails are opened and which links are clicked by recipients. This information facilitates more accurate reporting and improvement of our Site.
- Location Data: When you access our Site, we may access, collect, monitor, and/or remotely store information regarding your device, as well as real-time “location data,” which may include GPS coordinates. We may use your device’s physical location to provide you with personalized location-based services and content. In some instances, you may be permitted to allow or deny such uses and/or sharing of your device’s location, but if you do, we and/or our third party partners may not be able to provide you with the applicable personalized services and content.
- Information We Receive From Third Parties: We may receive Information about you from third parties. HOW WE DISCLOSE INFORMATION
Burlington discloses information about our customers to our affiliated companies, vendors, business partners and service providers. These companies need information about you, including your name, address, phone number, email address, to perform their service function (such as to process your payment and fulfill your order, verify your credit card information, and to protect you and us from fraud). We may also provide your information to third parties such as those that provide financial products and services related to our business and those that co-sponsors our contests, events or other promotions. We also disclose your information, including your name, address, phone number, email address, and shopping preferences, to specially chosen companies that help us with marketing functions (such as maintain and manage our customer information, as well as market our products and services). At times we may provide information to other companies that have a product or service that we believe will be of interest to you and/or may help them serve you better.

GOOGLE ANALYTICS
We use Google Analytics, a web analytics service provided by Google, Inc. (“Google”), on our Site. Google Analytics uses cookies to collect information such as how often you visit our Site, what pages you visit within our Site, and what other sites you visited prior to coming to our Site. We use the information provided by Google Analytics to improve our Site and services. HOW TO UPDATE YOUR PERSONAL INFORMATION
You may review, update, correct or delete your online account information at any time by contacting us to request changes to any of your information. We will respond to your request consistent with applicable law. Customers who no longer wish to receive our promotional materials may opt-out of receiving these communications by clicking the unsubscribe link at the bottom of any Burlington promotional email or contact us at (855) 355-BURL (2875). In some cases, we may need to retain and use personal information obtained previously to verify your identity and as otherwise required or permitted by applicable law.
When required in your jurisdiction (and described in the Supplemental Privacy Statement for California, Colorado, Connecticut, Delaware, Iowa, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Texas, Utah, and Virginia Consumers section below), Burlington will permit individuals to access, correct, amend or delete Personal Information that is demonstrated to be inaccurate or incomplete. If you request access, correction, amendment or deletion of your Personal Information and you have more than one account with us, you will need to instruct us on each account separately. CHILDREN’S PRIVACY
This Site is not designed or intended to be used by anyone under the age of 18. If you are under the age of 18 (or a minor in the jurisdiction in which you are accessing our Sites), do not use the Site, use any interactive features of the Site, or post any Personal Information to our Site. We do not knowingly or intentionally gather Personal information about children who are under the age of 16. Cookies are pieces of information stored directly on the device that you are using. Cookies allow us to collect information such as browser type, time spent on the Site, pages visited, language preferences, and other traffic data. We and our service providers use the information for security purposes, to facilitate navigation, to display information more effectively, and to personalize your experience. We also gather statistical information about use of the Site in order to continually improve their design and functionality, understand how they are used, and assist us with resolving questions regarding them. Cookies further allow us to select which of our advertisements or offers are most likely to appeal to you and display them while you are on the Services. CALIFORNIA PRIVACY RIGHTS
If you are a California resident, you have the right to make the following requests:
- Request to Know:
You have the right to request, up to twice in a 12-month period, that we disclose to you the categories and specific pieces of Personal Information we have collected about you. Specifically, you have the right to request that we disclose the following to you:
- the categories of Personal Information we have collected about you;
- the categories of sources from which the Personal Information about you was collected;
- our business or commercial purpose for collecting, selling, or “sharing” Personal Information about you;
- the specific pieces of Personal Information we have collected about you;
- the categories of Personal Information about you, if any, that we have sold or “shared” and the categories of third parties to which we have sold or “shared” such information; and
- the categories of Personal Information about you that we disclosed for a business purpose, and the categories of third parties to whom we disclosed such personal information.
- Request to Delete: You have the right to request that we delete Personal Information we have collected from you.
- Right to Correct: You have the right to request that we correct inaccuracies in your Personal Information.
- Request to Opt-Out of Sale and/or Sharing : You have the right to request to opt-out of the sale and/or “sharing” (for purposes of cross-context behavioral advertising as defined by the CCPA) of your Personal Information.
- Request to Limit Use of Sensitive Personal Information: You have the right to limit the use of your sensitive personal information to what is legally permissible.

- Request to Delete: To request that we delete Personal Information we have obtained about you.
- Request to Opt-Out of Sale and/or Targeted Advertising: To request to opt out of the sale of your Personal Information and/or the processing of your Personal Information for purposes of targeted advertising, and/or profiling in furtherance of decisions that produce legal or similarly significant effects.

Burlington honors the Global Privacy Control signals available in some browsers and plug-ins (described at https://globalprivacycontrol.org/) as opt-out of sale/sharing/targeted advertising requests. These signals set the opt-out of sale and sharing preferences for the particular browser or device you are using.

We will verify and respond to your request consistent with applicable law, taking into account the type and sensitivity of the personal information subject to the request. We may need to request additional personal information from you, such as email address, state of residency, or mailing address, in order to verify your identity and protect against fraudulent requests. If you make a Request to Delete, we may ask you to confirm your request before we delete your personal information.
Authorized Agents
If an agent would like to make a request on your behalf as permitted by applicable law, the agent may use the submission methods noted above under “Submitting a Rights Request.” As part of our verification process, we may request that the agent provide proof concerning their status as an authorized agent. In addition, we may require that the resident verify their identity as described in the section entitled “Submitting a Rights Request” or confirm that the resident provided the agent permission to submit the request.

Right to Notice and Non-Discrimination
You have the right to be informed, at or before the point of collection, of the categories of personal information to be collected from you and the purposes for which that Personal Information will be used.
You have the right to be free from unlawful discrimination for exercising any of your state privacy rights.
DEIDENTIFIED INFORMATION
Where we maintain or use de-identified information, we will continue to maintain and use that information only in a de-identified form and will not attempt to re-identify the information.
CALIFORNIA SHINE THE LIGHT REQUEST:
California Civil Code Section 1798.83 permits Burlington Stores, Inc. customers who are California residents to request certain information about our disclosure of personal information during the prior calendar year to third parties for their direct marketing purposes. NOTICE OF FINANCIAL INCENTIVE / LOYALTY PROGRAM
The California Consumer Privacy Act’s (the “CCPA”) implementing regulations define a “financial incentive” as a program, benefit, or other offering “for the collection, retention, sale, or sharing of personal information.” Likewise, the Colorado Privacy Act’s (the “CPA”) implementing rules define a “Bona Fide Loyalty Program” as a program “established for the genuine purpose of providing discounts, rewards, or other actual value” to members that voluntarily participate in the program. Burlington offers customers the opportunity to participate in its Burlington Loyalty Program (the “Program”), which may provide benefits, including extended returns, early notification of new arrivals/markdowns, e-receipts, and layaway bonuses, to those who choose to join (the “members”). Those benefits are described along with other material terms and conditions here.
Collecting members’ personal information (including name, email address, and phone number) allows Burlington to operate the Program and provide membership benefits. Burlington uses members’ personal information to award and redeem Program benefits. Otherwise, the types of personal information that Burlington collects from members are generally similar to the types of personal information that Burlington collects from individuals who are not members. The amount of personal information that Burlington collects from a member or non-member may vary and depends on the interactions that the member or non-member has with Burlington.
Burlington seeks to ensure that both members and non-members have a positive and rewarding experience when shopping at Burlington. For this reason, Burlington may collect information from both members and non-members related to their personal preferences in order to provide personalized services, as described above under “Processing of Personal Information”.
Burlington “sells,” as the term is defined under the CCPA and the CPA, personal information of both members and non-members to third parties to personalize online advertising content, as described above under “Sale and Sharing of Personal Information”. The following details are disclosed in Burlington’s “Supplemental Privacy Statement for California, Colorado, Connecticut, Utah, and Virginia Consumers” above:
- Categories of personal information “sold” to third parties;
- Categories of personal information processed for purposes of targeted advertising; and
- Categories of third parties that will receive members’ personal information, including sensitive personal information.
Burlington estimates the value of a member’s personal information to Burlington, solely for purposes of the CCPA and pursuant to the valuation options mandated by the CCPA regulations, to be reasonably related to the value of the benefits that members obtain through participating in the Program. Burlington bases this good faith estimate on: the value that arises from Burlington’s commercial relationships, such as with business partners, vendors, and customers; the costs and expenses Burlington incurs in offering benefits to members; the types of benefits provided; and the costs associated with the collection, use, retention, and enhancement of the personal information of consumers who have voluntarily signed up and chosen to remain members. The value of Program benefits to members varies significantly because individual members take advantage of Program benefits in different ways and to varying degrees.
You may join the Program on Burlington’s or at one of our stores.
Members who are California or Colorado residents may exercise their privacy rights, including the rights to know, correct, and opt out of the “sale” or “sharing” of personal information, without any impact on their membership status or eligibility to receive benefits, and members who exercise their privacy rights receive the same benefits as members who do not. If a member exercises their deletion right by choosing to delete their personal information, then Burlington will no longer be able to contact them in order to provide them with the Program benefits once Burlington has honored their deletion request.
